Swoop Deactivation Policy

This Deactivation Policy explains the only circumstances under which Swoop (WireUSmart LLC) will deactivate a contractor’s Swooper account, how contractors are notified, and how to appeal. It also describes the temporary compliance suspension that applies when a required document on file expires (Section 5) — a reversible hold that is not a deactivation. It is incorporated into the Swoop Independent Contractor Agreement.

1. Exclusive Grounds for Deactivation

Swoop may deactivate a contractor’s account only for the following enumerated reasons:

  1. Fraud or identity misuse — including submitting false service completions or photos, misrepresenting identity, sharing an account, or manipulating the platform or payouts.
  2. Safety violations or dangerous driving — conduct that endangers customers, residents, other drivers, or the public, including operating a vehicle recklessly or under the influence while performing services.
  3. Harassment or discrimination — harassing, threatening, abusive, or discriminatory conduct toward customers, residents, or any other person encountered while performing services.
  4. Repeatedly abandoning accepted jobs — a pattern of accepting service opportunities and then failing to complete or release them, leaving customers unserved. (This applies only to jobs the contractor accepted; see Section 6. A Swoop-initiated release or reassignment during a compliance suspension is never “abandoning” a job — see Section 5.4.)
  5. Material breach of the Independent Contractor Agreement — including failure to maintain a valid driver’s license or legally required automobile insurance. For an expired document, Swoop applies the temporary compliance suspension in Section 5 first; deactivation on this ground for an expired document occurs only as described in Section 5.6.
  6. Failure of a lawful background check — where the check was run with the contractor’s separate, lawful consent and adverse action is taken in compliance with the Fair Credit Reporting Act and applicable law.

No ground not listed above is a basis for deactivation.

2. Written Notice — Always

Every deactivation, without exception, will be communicated to the contractor in writing (in-app and by email) and will state:

  • the specific reason for the deactivation, described factually; and
  • the specific provision of this Policy or of the Independent Contractor Agreement on which the deactivation is based.

3. Appeals

  • A contractor may appeal any deactivation in the Swooper App or by email to support@swoopit.io.
  • Appeals are reviewed by a human reviewer — never solely by an automated system.
  • Swoop will review the appeal and respond within 7 days of receiving it.
  • The contractor may include any information or evidence they believe is relevant (photos, messages, records). If the appeal is granted, the account is reinstated promptly.

4. Egregious Conduct — Immediate Deactivation

Where conduct poses an immediate risk to the safety of customers, residents, or the public — for example, violence, credible threats, or fraud in progress — Swoop may deactivate the account immediately, before any review process. Even in these cases, the contractor will still receive written notice meeting the requirements of Section 2, and the appeal rights in Section 3 still apply.

5. Expired Documents — Temporary Compliance Suspension

A compliance suspension is a temporary, reversible hold that applies when the driver’s license or automobile insurance a contractor has on file with Swoop expires or becomes invalid. It exists to comply with law and protect customers and the public. A compliance suspension is not a deactivation and is not a disciplinary action.

5.1 Advance reminders. Swoop generally provides advance reminders — in-app, by email, and by push notification — before a document on file expires. Reminders are a courtesy: the contractor remains responsible for keeping documents current, and a reminder is not a precondition to suspension.

5.2 Automatic suspension at expiration. When a required document’s expiration date on file passes without a verified renewal, the account is suspended from receiving and accepting new service opportunities. This suspension may be applied automatically. The contractor’s account otherwise remains intact — earnings history, payout of amounts already earned, support access, and the ability to submit renewed documents are unaffected.

5.3 Written notice. Every compliance suspension is communicated in writing (in-app and by email), stating which document expired and how to submit a renewal.

5.4 Accepted jobs. Swoop may release or reassign Services the contractor accepted but has not yet performed, so affected customers can be served. A Swoop-initiated release or reassignment under this Section is never “abandoning” a job under Section 1(4) and carries no penalty of any kind.

5.5 Automatic reinstatement. The suspension lifts automatically once the contractor submits the renewed document and Swoop verifies it. Verification is an ordinary administrative review performed by a human reviewer — generally within 1–2 business days — and no appeal is required. The contractor is notified in writing when reinstated. If a contractor believes a compliance suspension was applied in error (for example, the document on file is in fact current), the appeal process in Section 3 is also available.

5.6 Prolonged lapse. A compliance suspension is not itself a ground for deactivation. However, if required documents remain expired for more than 60 consecutive days after suspension, Swoop may treat the lapse as a material breach under Section 1(5) and proceed with deactivation under the ordinary procedures of this Policy (written notice under Section 2; appeal rights under Section 3).

6. What Is Never Grounds for Deactivation

Declining, ignoring, or not viewing offered jobs is never grounds for deactivation, penalty, reduced access to the platform, or any other adverse action. Contractors alone decide when to be available and which service opportunities to accept. Acceptance rates are not a factor in account standing.
