This Privacy Policy describes how Swoop and Swooper, a service of wireusmart LLC ("we," "us," or "our"), collects, uses, and shares your personal information when you use our waste management services, our mobile apps (Swoop and Swooper), our enterprise portal, and our website. Our services are offered only to residents of the United States. If you are located outside the United States, please do not use our apps or website.

Information We Collect

Information You Provide

  • Account Information: Name, email address, phone number (including mobile phone number for SMS communications), billing address, and service address
  • Payment Information: Credit card numbers, bank account information, and billing details (processed by Stripe; we do not store full card numbers on our systems)
  • Service Address Details: Property address where services are performed, including gate codes, access instructions, pet information, and can locations
  • Communications: Messages, feedback, support requests, ratings, and any other information you choose to provide

Information We Collect Automatically

  • Usage Data: Service dates, times, completion status, and service history
  • Device Information: IP address, browser type, operating system, mobile device model, OS version, app version, and device identifiers
  • Location Data: Precise location (GPS) when you use our apps to schedule a service, track an active service, or set a pickup address. Driver location is collected continuously while a driver is on shift in the Swooper app (see "Drivers / Independent Contractors" below). We treat precise geolocation as Sensitive Personal Information.
  • Service Photos: Images of completed service for verification and quality assurance purposes
  • Push Notification Tokens: A device-specific token assigned by Apple Push Notification service or Google Firebase Cloud Messaging, plus app/OS metadata, used to deliver push notifications
  • Website and App Analytics: Pages visited, screens viewed, time spent, clicks/taps, referral sources, and product-event data

How We Use Your Information

We use your information for the following purposes:

Service Delivery

  • Provide and manage waste management services
  • Schedule and coordinate service appointments
  • Share necessary information with independent contractors performing services
  • Verify service completion and quality

Communications

  • Send service reminders and appointment confirmations
  • Provide service completion notifications
  • Send account alerts and billing notifications
  • Send SMS/text messages (if you have opted in)
  • Send push notifications (if enabled in your device settings)
  • Respond to your inquiries and support requests
  • Send promotional communications (with your consent)

Business Operations

  • Process payments and manage billing
  • Improve our services and customer experience
  • Analyze usage patterns and service trends
  • Comply with legal obligations
  • Prevent fraud and ensure security
  • Resolve disputes and enforce our agreements

Information Sharing

We share information with the following named service providers and categories of recipients. Each provider is contractually limited to using your information only to perform services for us.

Named Service Providers

Website Analytics & Advertising (Opt-In Only)

On swoopit.io we use the following only after you opt in via our cookie-consent banner:

These technologies do not run until you accept them in the cookie banner and you can change your choice at any time using the "Manage Preferences" control in the banner.

Other Recipients

  • Independent Contractors: Service providers (drivers) who perform waste management services on our behalf. They receive only the information necessary to perform a specific job.
  • Legal Requirements: When required by law, court order, subpoena, or governmental authority
  • Protection of Rights: To protect our rights, privacy, safety, or property, or that of our users or others
  • Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets
  • With Your Consent: When you have given us permission to share your information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising except through the opt-in-only website pixels listed above.

Push Notifications

When you allow push notifications in the Swoop or Swooper app, our push-notification provider (OneSignal) collects a device-specific push token, your operating system and app version, your IP address at the time the notification is delivered, and tags we set to route the right message (for example, "service-tomorrow" or "driver-active"). We use push notifications to confirm appointments, alert drivers to nearby jobs, notify you when a service is complete, and (only with your consent) to send promotional messages.

You can turn off push notifications at any time in your device's system settings, and you can manage marketing notifications in the app's notification preferences screen.

Sensitive Personal Information

Some categories of information we collect are considered "Sensitive Personal Information" under California, Florida, and other state privacy laws:

  • Precise geolocation (customer pickup location; driver location during shifts)
  • Financial account information (used by Stripe to process payments and driver payouts)
  • Government-issued identification (collected from drivers during onboarding for identity verification)
  • Social Security number (collected from drivers during Stripe Connect onboarding for KYC and 1099 tax reporting)

We use Sensitive Personal Information only for the purposes described in this policy — primarily to provide the service, process payments and payouts, and meet legal obligations. We do not use it to infer characteristics or for advertising. You may have a right to limit our use of Sensitive Personal Information; see "Your Rights" below.

Data Security

We implement reasonable administrative, technical, and physical security measures to protect your information, including:

  • Encryption of data in transit and at rest
  • Secure payment processing through PCI-compliant processors
  • Access controls and authentication requirements
  • Regular security assessments

However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

Data Retention

We retain your personal information for as long as necessary to provide services and comply with legal obligations. Specific retention periods include:

  • Account Information: Retained for the duration of your account and for 5 years after account closure for record-keeping and legal compliance
  • Payment Records: Retained for 7 years as required by financial regulations
  • Service Records: Retained for 5 years after service completion
  • Service Verification Photos: Retained for 90 days after service completion, unless needed for dispute resolution
  • Communication Records: Retained for 3 years after the communication
  • Website Analytics Data: Retained for 26 months
  • Driver Tax & KYC Records: Retained for 7 years after the driver's last paid service, as required by IRS and state tax authorities

Data Breach Notification

In the event of a data breach affecting your personal information, we will:

  • Notify affected individuals within the timeframe required by applicable law (typically 30-60 days)
  • Provide information about what data was affected
  • Describe the steps we are taking to address the breach
  • Offer guidance on steps you can take to protect yourself
  • Notify relevant regulatory authorities as required by law

Your Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of your personal information
  • Correction: Request correction of inaccurate information
  • Deletion: Request deletion of your personal information (subject to certain exceptions)
  • Opt-Out: Unsubscribe from marketing communications
  • Data Portability: Request your data in a portable format
  • Limit Use of Sensitive Personal Information: Limit how we use Sensitive Personal Information

California Residents - Your CCPA Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with additional rights regarding your personal information.

  • Identifiers: Name, email address, phone number, account name, IP address
  • Customer Records: Name, address, phone number, payment information
  • Commercial Information: Service history, purchase records, billing history
  • Internet/Network Activity: Browsing history, website interactions, device information
  • Geolocation Data: Precise physical location data from your device
  • Sensory Data: Photos of completed services
  • Sensitive Personal Information: Precise geolocation, financial account information, government ID and Social Security number (drivers only)
  • Inferences: Preferences and characteristics derived from your information

  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights

How to Exercise Your Rights

We will verify your identity before processing your request by matching the information you provide with information we have on file. You may designate an authorized agent to make a request on your behalf by providing written authorization.

Response Time: We will respond to verifiable requests within 45 days. If we need more time (up to an additional 45 days), we will notify you in writing.

Financial Incentives

We do not offer financial incentives or price differences in exchange for the collection or retention of personal information.

Florida Residents

If you are a Florida resident and we meet the thresholds under the Florida Digital Bill of Rights (effective July 1, 2024), you may have similar rights to access, correct, delete, and obtain a copy of your personal information. Contact us at privacy@swoopit.io to exercise these rights.

Other US State Residents

If you are a resident of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Delaware, New Hampshire, New Jersey, Maryland, or Minnesota, your state's privacy law may give you rights similar to those described above, including the right to access, correct, delete, and obtain a portable copy of your personal information; the right to opt out of targeted advertising, the sale of personal information, and certain profiling decisions; and (in some states) the right to appeal a denied request.

To exercise any of these rights, email privacy@swoopit.io. We will respond within the timeframe required by your state's law (typically 45 days). If we deny a request, you may appeal by replying to our denial; we will respond to the appeal within the time required by law.

Global Privacy Control (GPC)

We honor the Global Privacy Control browser signal as a valid request to opt out of any "sale" or "sharing" of personal information for cross-context behavioral advertising for the browser sending the signal. Because we already do not sell personal information, the GPC signal primarily disables the opt-in-only Meta Pixel, TikTok Pixel, and analytics technologies described above for that browser.

Drivers / Independent Contractors

Drivers ("Swoopers") who provide services through our platform are independent contractors. In addition to the categories described above, we collect from drivers:

  • Identity verification: government-issued ID image and Social Security number, collected during onboarding and shared with Stripe Connect for KYC and 1099 tax reporting
  • Insurance documents: proof of any insurance required to perform services
  • Vehicle information: make, model, license plate
  • Continuous location: precise location while a driver is on shift in the Swooper app, used to dispatch nearby jobs and to confirm service completion
  • Payout records: earnings, deductions, payout history, tax forms
  • Background-screening results: when a background check is performed, results are received under a separate FCRA-compliant disclosure and authorization process

We use this information to verify driver eligibility, dispatch services, process payouts, prepare tax forms, and meet legal and tax obligations. Driver KYC and tax records are retained for 7 years after the driver's last paid service.

Cookies and Tracking Technologies

We use cookies and similar tracking technologies on swoopit.io. When you first visit, our cookie-consent banner asks you to choose which categories you allow. You can change your choice at any time by clicking "Manage Preferences" in the banner.

Categories of Cookies

  • Essential (always on): Required for the website to function (session, security, load balancing)
  • Functional (opt-in): Remember your preferences and settings
  • Analytics (opt-in): Google Analytics 4 and PostHog, used to understand how visitors use the site
  • Marketing (opt-in): Meta Pixel and TikTok Pixel, used to measure ad performance. These do not run until you opt in.

Browser Cookie Controls

You can also control cookies through your browser settings (block, delete, or clear on close). Blocking essential cookies may affect your ability to use some features.

Do Not Track

Our website does not respond to legacy "Do Not Track" headers, but it does honor Global Privacy Control signals as described above.

SMS/Text Message Privacy

We send two kinds of text messages: service messages (appointment confirmations, service-completion alerts, account alerts) and marketing messages (promotions and offers).

  • We collect your mobile phone number to send service-related SMS once you provide it
  • Marketing SMS is sent only after you give separate, express written consent on the form where we collect your number, or in your account settings; consent to receive marketing texts is never a condition of purchase
  • We record consent metadata (timestamp, IP, opt-in source) for each opt-in
  • Your phone number is shared with our SMS delivery provider for the sole purpose of message delivery
  • You can opt out at any time by replying STOP to any message
  • We do not sell or share your phone number for third-party marketing purposes

Email Marketing

Every marketing email we send includes a working unsubscribe link. We process unsubscribe requests within 10 business days. Marketing emails also include the sender's physical postal address as required by the federal CAN-SPAM Act.

Apple App Store and iOS

  • App Tracking Transparency: The Swoop and Swooper apps ask for your permission via Apple's App Tracking Transparency prompt before any tracking across other apps or websites. If you decline, no cross-context tracking occurs.
  • Sign in with Apple: If you choose Apple's "Hide My Email" relay, we receive only the relay address and use it for service emails.

Account Deletion

You can delete your account at any time:

  • In the Swoop app: Profile → Delete Account.
  • In the Swooper app: Profile (or contact support@swoopit.io if a self-serve option is unavailable for your account state).
  • By email: Send a request to privacy@swoopit.io from the email address on file.

Some information may be retained as required by law or to resolve disputes (see "Data Retention" above).

Children's Privacy

Our services are intended for users who are at least 18 years of age. We do not knowingly collect personal information from anyone under 18. We comply with the Children's Online Privacy Protection Act (COPPA): if we learn we have collected personal information from a child under 13 we will delete it promptly. If you believe we have collected information from a person under 18, please contact us at privacy@swoopit.io.

International Users

Our services are offered only to residents of the United States and our servers are located in the United States. If you are located outside the United States, please do not use our apps or website.

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website with a new "Last Updated" date and, where required by law, by sending you an email notification. We encourage you to review this policy periodically.
